  • I forgot to say that what will happen usually if on the NCIC the cop's dispatcher will call up the state issuing the warrant and ask if they want to extradite, then within 10 minutes the state will call back and say that they won't.
    The 28 days period is only if they say they will, which won't happen with a trespassing ticket. Distance makes the decision for more serious offences, but even an adjacent state should be alright for a trespassing ticket.
    What up hey i have the same charges right now in another state, how it works, don't believe the cop, they'll lie, basically it depends what the state's policy is on sending warrants to the NCIC. Most states do not send misdemeanor warrants out to the NCIC.
    Georgia for one sends everything out to the NCIC, but doesn't actually come and pick up misdemeanor charges, it costs them thousands of dollars. So if you got a charge in Georgia, you could be taken to jail in another state and held for up to 28 days which is when they have to release you since the other state didn't come and pick you up
    . Though they can hold you for another 28 if they file some kind of form, most states won't hold you for the full 28 once they realize no-one's coming to pick you up.
    Does that make sense? It's actually a lot better than it sounds, as thousands of felons are on the lam for life and are A-OK since it's not worth a state's time to come pick them up.
